Germany is taking a proactive step to address its shortage of skilled workers by introducing the 'Opportunity Card' in June 2024. This new residence permit aims to attract talented professionals from around the world, providing them with a unique opportunity to live and work in Germany, even without a concrete job offer.

 

INTRODUCTION OF A JOB SEARCH OPPORTUNITY CARD

The German government is introducing an "opportunity card" to enable jobseekers to stay in Germany and look for employment. This card can be obtained in two ways:

·         Third-country nationals who receive full recognition of their foreign qualifications and are considered "skilled workers" under Section 18 para. 3 of the Residence Act (AufenthG) can obtain an opportunity card without any further special requirements.

·         All other applicants must provide evidence of a foreign university degree, a vocational qualification of at least two years' duration (recognised by the state in the country of training), or a vocational qualification issued by a German Chamber of Commerce Abroad. Additionally, they must demonstrate basic proficiency in German (level A1 CEFR) or English (level B2 CEFR).

If these requirements are met, points are awarded based on criteria such as recognition of qualifications in Germany, language skills, professional experience, age, existing ties to Germany, and the potential of accompanying partners or spouses. Applicants must score a minimum of six points to receive an opportunity card.

 

WHAT IS THE OPPORTUNITY CARD?

The Opportunity Card is a temporary residence permit that allows qualified individuals to stay in Germany for up to one year to search for employment opportunities that match their skills and qualifications. During this time, holders can participate in work trials, attend job interviews, and even take up secondary employment for a maximum of 20 hours per week.

 

EXTENSION OF THE OPPORTUNITY CARD

Opportunity cards are initially issued for a maximum of one year, provided that the holder can support themselves financially during that period. If an applicant is subsequently unable to obtain another residence permit for employment purposes under Part 4 (Sections 18 to 21 of the Residence Act [AufenthG]) but has an offer of qualified employment, the opportunity card can be extended for an additional two years.

 

WHO IS ELIGIBLE FOR THE OPPORTUNITY CARD?

The Opportunity Card is designed for skilled workers who meet specific criteria. Applicants must possess either

a foreign university degree,

a vocational qualification of at least two years' duration,

or a vocational qualification issued by a German Chamber of Commerce Abroad.

Additionally, they must demonstrate basic proficiency in German (level A1 CEFR) or English (level B2 CEFR).

For those with qualifications recognised in Germany, there are no further requirements to obtain the Opportunity Card. However, other applicants will undergo a points-based evaluation system.

 

POINTS-BASED EVALUATION SYSTEM

The points-based system assesses applicants based on various factors, including:

·         Recognition of qualifications in Germany

·         Language skills (German and English)

·         Professional experience

·         Age

·         Existing ties to Germany

·         Potential of accompanying partners or spouses
